This edited collection brings together a series of interdisciplinary contributions in the field of Information Technology Law. The topics addressed in this book cover a wide range of theoretical and practical legal issues that have been created by cutting-edge Internet technologies, primarily Big Data, the Internet of Things, and Cloud computing. Consideration is also given to more recent technological breakthroughs that are now used to assist, and - at times - substitute for, human work, such as automation, robots, sensors, and (...) algorithms. The chapters presented in this edition address these issues from the perspective of different legal backgrounds. The first part of the book discusses some of the shortcomings that have prompted legislators to carry out reforms with regard to privacy, data protection, and data security. Notably, some of the complexities and salient points with regard to the new European General Data Protection Regulation (EU GDPR) and the new amendments to the Japan's Personal Information Protection Act (PIPA) have been scrutinized. The second part looks at the vital role of Internet intermediaries (or brokers) for the proper functioning of the globalized electronic market and innovation technologies in general. The third part examines an electronic approach to evidence with an evaluation of how these technologies affect civil and criminal investigations. The authors also explore issues that have emerged in e-commerce, such as Bitcoin and its blockchain network effects. Artificial intelligence and related technologies are changing both the law and the legal profession. In particular, technological advances in fields ranging from machine learning to more advanced robots, including sensors, virtual realities, algorithms, bots, drones, self-driving cars, and more sophisticated "human-like" robots are creating new and previously unimagined challenges for regulators. These advances also give rise to new opportunities for legal professionals to make efficiency gains in the delivery of legal services. With the exponential growth of such technologies, radical disruption (...) seems likely to accelerate in the near future. This collection brings together a series of contributions by leading scholars in the newly emerging field of artificial intelligence, robotics, and the law. The aim of the book is to enrich legal debates on the social meaning and impact of this type of technology. The distinctive feature of the contributions presented in this edition is that they address the impact of these technological developments in a number of different fields of law and from the perspective of diverse jurisdictions. There is a broad consensus amongst law firms and in-house legal departments that next generation "Legal Tech" - particularly in the form of Blockchain-based technologies and Smart Contracts - will have a profound impact on the future operations of all legal service providers. Legal Tech startups are already revolutionizing the legal industry by increasing the speed and efficiency of traditional legal services or replacing them altogether with new technologies. This on-going process of disruption within the legal profession offers significant opportunities (...) for all business. However, it also poses a number of challenges for practitioners, trade associations, technology vendors, and regulators who often struggle to keep up with the technologies, resulting in a widening regulatory "gap." Many uncertainties remain regarding the scope, direction, and effects of these new technologies and their integration with existing practices and legacy systems. Data sharing – broadly defined as the exchange of health-related data among multiple controllers and processors – has gained increased relevance in the health sciences over recent years as the need and demand for collaboration has increased. This includes data obtained through healthcare provisions, clinical trials, observational studies, public health surveillance programs, and other data collection methods. The practice of data sharing presents several notable challenges, however. Compliance with a complex and dynamic regulatory framework is essential, with the General Data (...) Protection Regulation being a prominent example in a European context. Recent regulatory developments related to clinical trial transparency, trade secrecy, data access, AI training data, and health data spaces further contribute to the difficulties. In this paper, we argue that the Epicurean genealogy of justice and laws presuppose an analysis of the just as a modality of the useful, an approach that denies the conventional character of justice. This genealogical pattern differentiates the origin of justice from that of the law and refers to friendship as a relevant explanatory factor of the origin of justice. We maintain that the interpretations that underline the incoherence of this reference to friendship, in the framework of a hedonistic (...) theory, presuppose a non-Epicurean sharp distinction between altruism and selfishness. In this paper, we argue that the fact that there were prominent citizens of different Greek cities who adhered to Epicureanism, felt themselves Epicurean, and were recognized as such, shows that slogans such as “live unnoticed” and “do not participate in politics” (which suggest a complete apoliticism on Epicurus’ and the Epicureans’ part) misrepresent the true meaning of the Epicurean staying away from contingent politics. Our article shows the interaction between Epicurus and the Epicureans and the Greek cities through the (...) analysis of documents (some of them, well known -such as Epicurus’ Testament, which shows the connections of the philosopher with the political life of the city-, others less known of epigraphic character) related to different ancient cities. If what we argue is sound, the usual idea that Epicureanism recommends apoliticism must be discarded. (shrink)

There are two foundational, but not fully developed, ideas in paraconsistency, namely, the duality between paraconsistent and intuitionistic paradigms, and the introduction of logical operators that express metalogical notions in the object language. The aim of this paper is to show how these two ideas can be adequately accomplished by the logics of formal inconsistency and by the logics of formal undeterminedness. LFIs recover the validity of the principle of explosion in a paraconsistent scenario, while LFUs recover the validity of (...) the principle of excluded middle in a paracomplete scenario. We introduce definitions of duality between inference rules and connectives that allow comparing rules and connectives that belong to different logics. Two formal systems are studied, the logics mbC and mbD, that display the duality between paraconsistency and paracompleteness as a duality between inference rules added to a common core—in the case studied here, this common core is classical positive propositional logic. The logics mbC and mbD are equipped with recovery operators that restore classical logic for, respectively, consistent and determined propositions. These two logics are then combined obtaining a pair of LFI and undeterminedness, namely, mbCD and mbCDE. The logic mbCDE exhibits some nice duality properties. Besides, it is simultaneously paraconsistent and paracomplete, and able to recover the principles of excluded middle and explosion one at a time. The last sections offer an algebraic account for such logics by adapting the swap structures semantics framework of the LFIs the LFUs. This semantics highlights some subtle aspects of these logics, and allows us to prove decidability by means of finite nondeterministic matrices. (shrink)

We investigate the dynamics of sensory integration for perceiving musical performance, a complex natural behavior. Thirty musically trained participants saw, heard, or both saw and heard, performances by two clarinetists. All participants used a sliding potentiometer to make continuous judgments of tension (a measure correlated with emotional response) and continuous judgments of phrasing (a measure correlated with perceived musical structure) as performances were presented. The data analysis sought to reveal relations between the sensory modalities (vision and audition) and to quantify (...) the effect of seeing the performances on participants' overall subjective experience of the music. In addition to traditional statistics, functional data analysis techniques were employed to analyze time-varying aspects of the data. The auditory and visual channels were found to convey similar experiences of phrasing but different experiences of tension through much of the performances. We found that visual information served both to augment and to reduce the experience of tension at different points in the musical piece (as revealed by functional linear modeling and functional significance testing). In addition, the musicians' movements served to extend the sense of phrasing, to cue the beginning of new phrases, to indicate musical interpretation, and to anticipate changes in emotional content. Evidence for an interaction effect suggests that there may exist an emergent quality when musical performances are both seen and heard. The investigation augments knowledge of human communicative processes spanning language and music, and involving multiple modalities of emotion and information transfer. (shrink)

We examine the most famous controversy between economists as a means of shedding fresh light on the current debate about economic methodology. By focusing on the controversy as the primary unit of analysis, we show how methodological considerations are but one of a whole set of stratagems strategically employed by each opponent. We argue that each opponent's preference for a particular kind of stratagems expresses his own specific scientific style (within the general scientific and cultural style of an age). We (...) also describe a dynamic dimension of the controversy, independent of the participants' intentions. Such a dimension is analysed in a "cycle" of the controversy, which begins with a well-defined issue and expands to additional topics, without reaching a "solution" to the initial issue. The definition and re-definition of the issue(s) at stake and of the difference between both participants is an essential and recurrent feature of such cycles; the conclusion of a cycle does not imply a real "closure" of the controversy, but only that each opponent has reached a satisfying degree of self-clarification. The controversy, thus, does not yield persuasion -- its ostensible aim. Rather, its "benefit" seems to lie in an unintended result -- clarification and deepening of contrasting approaches to the discipline -- due to its peculiar dynamics. In so far as the history of a discipline requires a reconstruction of such contrasts, it is indispensable for it to take into account the controversies where they emerge, and to view both the positive doctrines and the methodological posture of the contenders as parts of a wider framework, that is a scientific style. Walter Bock was committed to developing a framework for evolutionary biology. Bock repeatedly discussed how evolutionary explanations should be considered within the realm of Hempel’s deductive-nomological model of scientific explanations. Explanation in evolution would then consist of functional and evolutionary explanations, and within the latter, an explanation can be of nomological-deductive and historical narrative explanations. Thus, a complete evolutionary explanation should include, first, a deductive functional analysis, and then proceed through nomological and historical evolutionary explanations. However, I will argue that (...) his views on the deductive proprieties of functional analysis and the deductive-nomological parts of evolution fail because of the nature of evolution, which contains a historical element that the logic of deduction and Hempel’s converting law model do not compass. Conversely, Bock’s historical approach gives a critical consideration of the historical narrative element of evolutionary explanation, which is fundamental to the methodology of the historical nature of evolutionary theory. Herein, I will expand and discuss a modern view of evolutionary explanations of traits that includes the currentacknowledgement of the differences between experimental and the historical sciences, including the token and type event dichotomy, that mutually illuminate each other in order to give us a well confirmed and coherent hypothesis for evolutionary explanations. Within this framework, I will argue that the duality of evolutionary explanations is related to two components of character evolution: origin, with its evolutionary pathways along with the history, and maintenance, the function (mainly a current function) for the character being selected. This paper investigates the question of characterizing first-order LFIs (logics of formal inconsistency) by means of two-valued semantics. LFIs are powerful paraconsistent logics that encode classical logic and permit a finer distinction between contradictions and inconsistencies, with a deep involvement in philosophical and foundational questions. Although focused on just one particular case, namely, the quantified logic QmbC, the method proposed here is completely general for this kind of logics, and can be easily extended to a large family of quantified paraconsistent (...) logics, supplying a sound and complete semantical interpretation for such logics. However, certain subtleties involving term substitution and replacement, that are hidden in classical structures, have to be taken into account when one ventures into the realm of nonclassical reasoning. This paper shows how such difficulties can be overcome, and offers detailed proofs showing that a smooth treatment of semantical characterization can be given to all such logics. Although the paper is well-endowed in technical details and results, it has a significant philosophical aside: it shows how slight extensions of classical methods can be used to construct the basic model theory of logics that are weaker than traditional logic due to the absence of certain rules present in classical logic. Several such logics, however, as in the case of the LFIs treated here, are notorious for their wealth of models precisely because they do not make indiscriminate use of certain rules; these models thus require new methods. In the case of this paper, by just appealing to a refined version of the Principle of Explosion, or Pseudo-Scotus, some new constructions and crafty solutions to certain non-obvious subtleties are proposed. The result is that a richer extension of model theory can be inaugurated, with interest not only for paraconsistency, but hopefully to other enlargements of traditional logic. (shrink)

Resumen Este artículo explora las figuras del flâneur y del "mestizo". Reúno con el sustantivo "mestizo" una serie de operaciones estilísticas y retóricas que emplea Echeverría para describir el mestizaje como fenómeno histórico de las sociedades urbanas en las colonias españolas en los siglos XVI y XVII. Partiré de la lectura de Echeverría a Benjamin de principios de los años noventa. Luego analizaré la figura del flâneur y la del mestizo para mostrar algunas líneas de conexión, desde la estrategia alegórica (...) a la relación entre el barroco y la sociedad moderna. Por último, consideraré ambas figuras como paradigmas de sujetidad barroca, es decir, como principios de inteligibilidad de formas sociales que resisten las contradicciones de la modernidad capitalista.This article explores two figures: the flâneur and the "mestizo". Under the word "mestizo" I gather a group of stylistic and rhetorical operations that Echeverría uses to describe mestizaje as a historical phenomenon occurred in the urban societies of spanish Colonies during the 16th and 17th centuries. I start with a historical approach to Echeverría's readings of Benjamin from the beginning of the 1990s. Then I show some possible connections between both figures, from the allegorical strategy to the relationship between baroque and modern society. Finally, I conceive them as paradigms of baroque sujetity; that is, principles of intelligibility of social forms that resist the contradictions of Western modern capitalism. (shrink)

This paper presents REAL, a Real-Valued Attribute Classification Tree Learning Algorithm. Several of the algorithm's unique features are explained by úe users' demands for a decision support tool to be used for evaluating financial operations strategies. Compared to competing algorithms, in our applications, REAL presents maj or advantages : (1) The REAL classification trees usually have smaller error rates. Although a very recent topic in contemporary logic, the subject of combinations of logics has already shown its deep possibilities. Besides the pure philosophical interest offered by the possibility of defining mixed logic systems in which distinct operators obey logics of different nature, there are also several pragmatical and methodological reasons for considering combined logics. We survey methods for combining logics (integration of several logic systems into a homogeneous environment) as well as methods for decomposing logics, showing their interesting properties (...) and applications. In this paper we propose a very general de nition of combination of logics by means of the concept of sheaves of logics. We first discuss some properties of this general definition and list some problems, as well as connections to related work. As applications of our abstract setting, we show that the notion of possible-translations semantics, introduced in previous papers by the first author, can be described in categorial terms. Possible-translations semantics constitute illustrative cases, since they provide a new (...) semantical account for abstract logical systems, particularly for many-valued and paraconsistent logics. A sustainable supply chain management strategy reduces risks and meets environmental, economic and social objectives by integrating environmental and financial practices. In an ever-changing environment, supply chains have become vulnerable at many levels. In a global supply chain, carefully tracing a product is of great importance to avoid future problems. This paper describes a self-updating smart contract, which includes data validation, for tracing global supply chains using blockchains. Our proposal uses a machine learning model to detect anomalies on traceable data, (...) which helps supply chain operators detect anomalous behavior at any point in the chain in real time. Hyperledger Caliper has been used to evaluate our proposal, and obtained a combined average throughput of 184 transactions per second and an average latency of 0.41 seconds, ensuring that our proposal does not negatively impact supply chain processes while improving supply chain management through data anomaly detection. Given the abrupt global disruption caused by SARS-CoV-2, one might think that the COVID pandemic was an unpredictable event. But in the years leading up to the emergence of the COVID pandemic, several documents had already been warning of the increasing occurrences of new disease outbreaks with pandemic potential and lack of corresponding policies to promote pandemic preparedness and response. In this article, we call these documents “early warnings”. We argue that a survey of early warnings can help science communicators (...) to promote the public understanding of evidence-based pandemic preparedness and response policies at local or international level. Our proposal differs from other approaches to pandemic preparedness and response in that it highlights the relevance of documents published before the COVID outbreak. We show that the early warnings did not become outdated after the COVID outbreak, but, rather, that they are even more pressing now. (shrink)

What are human rights? Do they exist? I propose to answer these questions by advancing a contractarian account of human rights. I focus on the human right to found a family and have children. I also show how the contractarian approach to human rights can explain the current relevance of reproductive rights in the human rights discourse, and how the emergence of ART (Assisted Reproductive Technologies) has contributed to this shift. The contractarian account of human rights asks, firstly, the following (...) question: which basic needs and desires can be ascribed to any human being regardless of gender, nationality, sexual orientation, age, ethnicity etc.? Having an interest, for instance, in preserving one’s own bodily integrity, freedom, and private property qualifies as a basic human need or basic desire. But a basic human need or desire does not constitute in itself a human right. Secondly, the contractarian account of human rights asks, then, which basic human needs or basic desires individuals and states representatives would consider so important that they would agree to create institutional frameworks, both at the domestic and international level, in such a way as to enable individuals to pursue the fulfilment of their basic needs or desires without state interference. Human rights exist and can only be claimed in the context of these normative frameworks. (shrink)

Este artigo tem como objetivo analisar a Sociologia do Direito de Jürgen Habermas, mostrando a centralidade do direito na sua teoria da ordem social. Como sociólogo formado na tradição alemã de grandes sínteses filosóficas, Habermas, em seu livro " Direito e Democracia – Entre facticidade e validade ", que nos guiará neste artigo, descreve o objetivo ambicioso de produzir uma teoria geral da ação social à maneira de Parsons. Em sua explicação sobre a natureza das sociedades, o direito positivo é (...) entendido como uma linguagem estabilizadora das interações sociais tendo o importante papel de estruturar a ordem social. Celebrado entre os juristas, o entendimento completo das proposições de Habermas requer conhecimento amplo e crítico das teorias sociológicas sobre a natureza da ordem social. Muitas vezes secundarizado por sociólogos, especialmente os tradicionalistas e conservadores, o autor promove um entendimento das normas legais como um processo dialógico e multideterminado, que não é apenas um reflexo das relações sociais, mas que também estabelece parâmetros para a composição de conflitos inerentes às interações sociais. Internal misconduct is a universal problem in prisons and affects the maintenance of social order. Consequently, correctional institutions often develop rehabilitation programs to reduce the likelihood of inmates committing internal offenses and criminal recidivism after release. Therefore, it is necessary to identify the profile of each offender, both for the appropriate indication of a rehabilitation program and the level of internal security to which he must be submitted. In this context, this work aims to discover the most significant characteristics in (...) predicting inmate misconduct from ML methods and the SHAP approach. A database produced in 2004 through the Survey of Inmates in State and Federal Correctional Facilities in the United States of America was used, which provides nationally representative data on prisoners from state and federal facilities. The predictive model based on Random Forest performed the best, thus, we applied the SHAP to it. Overall, the results showed that features related to victimization, type of crime committed, age and age at first arrest, history of association with criminal groups, education, and drug and alcohol use are most relevant in predicting internal misconduct. Thus, it is expected to contribute to the prior classification of an inmate on time, to use programs and practices that aim to improve the lives of offenders, their reintegration into society, and consequently, the reduction of criminal recidivism. Defendemos a necessidade de que se atue com rigor ético durante a pandemia do novo coronavírus e que não se afrouxem os padrões científicos e normativos nas pesquisas sobre possíveis medicamentos, em especial a Cloroquina, para a COVID-19. Argumentamos que, excepcionalmente, seria justificado pular algumas etapas na realização de testes clínicos ou tratamentos experimentais, mas que é inadequado fazer um uso indiscriminado de medicamentos off label para tratar pacientes enquanto os resultados das pesquisas não forem publicados em veículos de comprovada (...) reputação científica. Para sustentar essa posição, aplicamos princípios bioéticos e da ética médica. Defendemos que políticas públicas para o uso de Cloroquina durante a pandemia não devem ser implementadas até que sejam divulgados os resultados das pesquisas realizadas pela “Coalizão COVID Brasil” e pela Solidarity da OMS. El presente artículo pretende destacar que las respuestas afectivas de los seres humanos ante la realidad son constitutivas de los juicios morales desde dos perspectivas: a) un ordo amoris objetivo con funciones normativas; b) un ordo amoris descriptivo que explica las variaciones en los juicios morales. El problema filosófico consiste en que la descripción de la afectividad suele ser abordada por ciencias empíricas y es parte de la casuística. Pero, desde la perspectiva fenomenológica de Max Scheler se hace posible su (...) abordaje filosófico, sin caer en la casuística. De modo análogo, a lo que sucede en la lógica y su tratamiento de las falacias, la axiología fenomenológica puede describir la afectividad en busca de aquellos elementos que distorsionan el juicio moral. This article aims to emphasize that affective responses of human beings to reality are constitutive of moral judgments from two perspectives: a) an objective ordo amoris with normative functions; b) a descriptive ordo amoris, which explains the variety of moral judgments. The philosophical problem consists in the fact that description of affectivity is usually examined by empirical sciences and is part of casuistry. But from the point of view of Max Scheler’s phenomenology it is possible to study this issue without the tendency to casuistry. In a similar way to logic and its dealing with fallacies, phenomenological axiology is able describe emotions seeking those elements that distort moral judgment. (shrink)

Although the reception of John Dewey's _Art as Experience_ has not been totally ignored by secondary literature, the few works that have dealt with the subject have been restricted to the English-speaking context, and more specifically to the United States. This essay sought to consider the reception of Dewey's book on aesthetics in the context of Spanish-speaking countries, with special attention to Mexico, Spain, Colombia, and Argentina. The hypothesis put forward and supported here is that _Art as Experience_ had a (...) late reception due to political and cultural factors in these countries and that it is at present that we really find a deeper reception of this work, with an increasing number of publications about the subject. The possibility of morally enhancing the behavior of individuals by means of drugs and genetic engineering has been the object of intense philosophical discussion over the last few years. However; although moral enhancement may turn out to be useful to promote cooperation in some areas of human interaction; it will not promote cooperation in the domain of international relations in those areas that are critical to state security. Unlike some moral enhancement theorists; I argue that; because of the structure of (...) the system of states; moral enhancement cannot be used to avert such major threats to humankind as terrorism and nuclear conflict. My analysis of the political implications of moral enhancement is pursued through a critical discussion of two different versions of political realism; namely human nature realism and structural realism. I conclude that; as far as major threats to the survival of humankind are concerned; moral enhancement can at most be used as a means to change the present structure of the system of states. Urban development is seen in this paper as the process of achieving more social justice in the city through changes both in social relations and in spatiality. Autonomy, in the sense used by Cornelius Castoriadis, is here regarded as the main parameter for the evaluation of processes and strategies for positive social change. Nevertheless, the Castoriadian philosophical notion of autonomy must first be made operational before it can be reasonably applied in empirical research or policy evaluations. La literatura nacida en ámbito monástico o asociada al mismo, ofrece aspectos ponderables sobre la antropología teológica. Señalaremos algunos conceptos al respecto, sobre todo a partir de la memoria y la construcción de la propia identidad. El Himno de la Perla se caracteriza por haber sido objeto de disímiles interpretaciones, siendo considerado desde un texto iranio a una composición gnóstica. Presentaremos una lectura narrativa, tomando como categorías de aproximación el recuerdo y el olvido, a partir de las cuales plantearemos un (...) posible vínculo entre el Himno de la Perla y el Pseudo-Macario. Quispel, ya en 1967, estableció un parentesco de Teología (Verwandschaft der Teologie), destacando que también se encuentran paralelismos de forma. Tomando en cuenta este notable aporte, procuraremos indagar en la literatura pseudo-macariana acerca de tales parentescos con el Himno de la Perla y la literatura sobre el apóstol Tomás. (shrink)

Bajo un paradigma cualitativo-interpretativo este estudio realizó un análisis a partir del discurso de futuros profesores en Chile en torno a su formación y la incorporación de la variable género en clave de inclusión. A partir de las dimensiones definidas previamente, se levantaron categorías que emergieron del discurso, aplicadas a la conversación y a los actos de habla. Las principales conclusiones dan cuenta del reconocimiento de la importancia de esta perspectiva, en el reconocimiento de aulas diversas para las cuales se (...) tienen intuitivas, o desde lo aprendido autónomamente, pero no desde lo adquirido en la formación inicial como profesores. Este artículo tiene como objetivo explorar y dilucidar las distinciones fundamentales entre la inteligencia artificial (IA) y la inteligencia sentiente, tal como se propone en la filosofía de Xavier Zubiri. El estudio busca comprender hasta qué punto la IA puede replicar aspectos de la inteligencia humana y cómo la comprensión de la inteligencia sentiente puede informar e influenciar el desarrollo futuro de la IA. La investigación adoptó un enfoque cualitativo, utilizando una investigación bibliográfica para construir un marco teórico sólido sobre (...) la IA y la inteligencia sentiente. Además, se realizó un análisis de contenido para comparar la inteligencia artificial con la inteligencia sentiente, con un enfoque en la filosofía de Xavier Zubiri, que permitió identificar dos categorías principales relacionadas con la IA desde la perspectiva de la inteligencia sentiente: características ausentes y presentes de la IA según la comprensión de la inteligencia sentiente. Dentro de las características ausentes, se encontraron 14 unidades de registros; para las características presentes, 7 unidades de registro, con un total de 21 códigos. El estudio concluye que, aunque la inteligencia artificial puede imitar ciertos aspectos de la inteligencia humana, no puede replicar la totalidad de la experiencia sentiente. (shrink)

This paper defends that the both the Buddhist tradition and the Aristotelian allow us to think of the distinction between to reason with contradictions and to accept them, understanding ' accept a contradiction ' by taking it as consistent. From this viewpoint, none of two would disagree with most contemporary paraconsistent views. The conclusions are, thus, that, firstly, there is no compelling reason to endorse any kind of metaphysical dialetheism, and, second, that a coherent form of reasoning with contradictory statements (...) is neither opposed to the Aristotelian conception of logic, nor to certain texts in the Buddhist tradition, as the Madhyamikas. Although the concept of _social value_ has been present in business literature for over a century, it lacks definitional consensus, is often imprecise, and has not been sufficiently theorized. With social value becoming more prevalent across business scholarship domains, the lack of conceptual clarity and consistency hampers substantive research progress. We conduct an integrative review of 288 articles drawn from 60 peer-reviewed journals covering a wide spectrum of business domains. We synthesize the review findings into a polythetic typology that identifies (...) five distinct approaches to understanding and managing social value in business. The proposed typology of social value organizes and consolidates the theoretical and conceptual heterogeneity of the social value concept providing much-needed clarity and structure for future research. It allows scholars to structure and unify various conceptualizations into a more holistic yet nuanced understanding, and the necessary (but currently lacking) clarity to enable new theorizing and guide future research. The proposed typology further offers new ways of thinking about social value and provides direction to managerial practice on the desirability and feasibility of implementing different social value approaches into firms’ core business operations and strategies. O presente artigo se debruça sobre a temática da Psicologia e a Educação. O recorte do tema reflete a necessidade da ação da psicologia no ambiente escolar. O estudo se constitui uma breve análise quanto aos enfrentamentos à saúde mental dos estudantes na etapa da infância. De cunho qualitativo e de natureza básica, este é excerto de pesquisa bibliográfica, utilizando-se de referências que conversam com a temática abordada. Busca-se entender: De que modo o psicólogo escolar pode auxiliar as crianças que (...) se encontram em depressão? Como identificar a depressão infantil no contexto escolar? Nesse sentido, busca-se compreender as ações do psicólogo escolar, em confronto com os problemas da depressão infantil. Do estudo foi possível perceber que: existe a depressão infantil e esta forma as lacunas nas aprendizagens das crianças; torna-se evidente a necessidade de manter o diálogo entre a escola e a família buscando sanar os efeitos da depressão infantil; a presença e a ação do psicólogo escolar, no ambiente da Educação, poderá se constituir uma medida preventiva que promova uma infância sadia e mais cidadã; o psicólogo escolar nos processos de intervenção precisa ressaltar a reflexão crítica, democrática e humanizadora dos sujeitos. Em 1980, o papa João Paulo II visitou o Brasil pela primeira vez. A extensa programação pontifícia incluiu encontro do papa com o operariado brasileiro, no estádio do Morumbi, São Paulo. Ali, Karol Wojtyla foi saudado por Waldemar Rossi, liderança operária leiga da arquidiocese paulistana. Rossi redigiu discurso bastante crítico em relação à condição dos trabalhadores nacionais e também quanto à situação política então vigente. Discurso esse que teria sido encurtado por razões ainda obscuras. No presente artigo, propõe-se que tal (...) episódio revela a tensão que cercou a visita papal. Tensão presente na praça pública brasileira, com o país vivenciando sua mais longa ditadura, bem como no interior do catolicismo nacional, por conta de polêmicas teológicas e pastorais. Assim, quer-se analisar texto integral e contexto do discurso escrito por Rossi e as possíveis implicações de seu parcial silenciamento, episódio pouco debatido até agora. (shrink)
